These Terms and Conditions govern your access to and use of all products and services offered by Cycle Strong, including but not limited to group coaching programs, 1:1 coaching, digital products, and any future offerings (collectively, “Services”). By purchasing or enrolling in any Cycle Strong Service, you agree to be bound by these Terms.
Please read these Terms carefully before enrolling. If you do not agree to these Terms, do not proceed with your purchase or enrolment.
1 Definitions
In these Terms and Conditions:
• “Australian Consumer Law” or “ACL” means the legislation contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth);
• “Client” means any person who purchases or enrols in a Cycle Strong Service;
• “Digital Products” means any downloadable guides, templates, resources, or other digital content offered for sale by Cycle Strong;
• “Group Program” means any cohort-based online group coaching program offered by Cycle Strong, including Cycle Strong Foundation and any future group programs;
• “1:1 Coaching” means any individual private coaching arrangement between Cycle Strong and a Client;
• “Services” means all products and services offered by Cycle Strong including Group Programs, 1:1 Coaching, Digital Products, and any other current or future offerings;
• “Terms” means these Terms and Conditions as amended from time to time;
• “We/Us/Our” means Cycle Strong, operated by Amanda Bakker, cyclestrong.com.au, [email protected];
• “You/Your” means the Client purchasing or enrolling in a Cycle Strong Service.
2 Acceptance of Terms
(a) These Terms enter into force upon your purchase or enrolment in any Cycle Strong Service and continue for the duration of that Service.
(b) By completing a purchase or enrolment, you confirm that you have read, understood, and agree to be bound by these Terms.
(c) These Terms apply to all Cycle Strong Services. Additional terms specific to individual programs or products may be communicated at the time of purchase and form part of these Terms.
3 Services
(a) Cycle Strong offers a range of online coaching and educational Services including Group Programs, 1:1 Coaching, and Digital Products. The specific inclusions, duration, delivery method, and pricing for each Service will be set out at the time of purchase.
(b) Group Programs are delivered on a cohort basis with fixed start dates. By enrolling, you acknowledge and accept the scheduled start date and program duration as communicated at the time of enrolment.
(c) We reserve the right to modify, reschedule, or discontinue any Service at our discretion. Where a material change affects a Service you have paid for, we will notify you promptly and offer a reasonable remedy, which may include a transfer to a future cohort, a credit toward another Service, or, where required under the Australian Consumer Law, a refund.
(d) In the event that a Group Program cohort is cancelled prior to commencement, enrolled Clients will be offered a full refund or transfer to the next available cohort at their election. Where a cohort is cancelled after commencement, we will assess each situation individually and offer a remedy proportionate to the Services not yet delivered.
(e) Access to third-party platforms used to deliver our Services (including any workout delivery platform, community or social platform, or payment processor used at the time of enrolment) is subject to the terms and conditions of those platforms. We are not responsible for interruptions or changes to third-party platforms outside our control.
3A Live Coaching Calls
(a) Group Programs include regular live coaching calls delivered via Zoom, Facebook Live or alternate online delivery. These calls where possible are scheduled in advance and communicated to enrolled Clients. Attendance is encouraged but not mandatory. A recording or written summary will be made available to enrolled Clients where reasonably practicable.
(b) We reserve the right, at our sole discretion, to reschedule, shorten, or substitute a live call due to unforeseen circumstances including illness, technical failure, or other events outside our reasonable control. Where a call is rescheduled, reasonable notice will be provided. Where a call cannot be rescheduled, a recording, written summary, or equivalent resource will be offered as an alternative.
(c) Live call recordings may be shared within the private program community for the benefit of enrolled Clients only. Recordings must not be downloaded, redistributed, or shared outside the program environment without our prior written consent.
4 Payment
(a) All prices are displayed in Australian Dollars (AUD) and are inclusive of any applicable taxes unless otherwise stated.
(b) Payment is required in full at the time of purchase unless a payment plan has been expressly agreed in writing.
(c) Payments are processed securely via Stripe. By providing your payment details, you authorise us to charge the relevant amount to your nominated payment method.
(d) Access to your purchased Service will be granted upon confirmation of successful payment.
5 Refunds and Cancellations
(a) Due to the digital and time-sensitive nature of our Services, we do not offer refunds for change of mind once a purchase has been made or access to a Service has been granted.
(b) Nothing in these Terms limits, excludes, or modifies your rights under the Australian Consumer Law. If a Service has a major failure as defined under the ACL, you are entitled to a remedy in accordance with your statutory rights. This includes circumstances where the Service is not delivered as described or is not fit for the purpose for which it was purchased.
(c) If you believe a Service has a major failure, please contact us at [email protected] as soon as practicable so we can assess your request.
(d) For Group Programs, no refund will be provided where you are unable to participate due to personal circumstances, scheduling conflicts, or change of mind after enrolment.
(e) Digital Products are non-refundable once downloaded or accessed.
6 Health Disclaimer and Medical Advice
(a) Cycle Strong provides fitness coaching, training programs, and educational content relating to hormonal health and cycle-synced training. Nothing in our Services constitutes medical advice, diagnosis, or treatment.
(b) You should consult a qualified medical practitioner or healthcare provider before commencing any new fitness program, particularly if you have a pre-existing health condition, injury, hormonal condition (including but not limited to PCOS, endometriosis, or conditions related to perimenopause or menopause), or any other health concern that may affect your ability to participate safely.
(c) By purchasing or enrolling in any Cycle Strong Service, you confirm that you are physically able to participate in the activities involved and that you have sought or will seek appropriate medical clearance where necessary.
(d) The educational content provided in our Services, including information about hormones, the menstrual cycle, and training principles, is intended for general informational purposes only. It is not a substitute for professional medical advice. Individual results will vary.
(e) You are responsible for your own health and safety during all training activities. If at any point you experience pain, discomfort, dizziness, or any adverse symptoms, you should stop the activity immediately and seek appropriate medical attention.
7 Release and Indemnity
(a) To the fullest extent permissible under law, you release Cycle Strong and its operator, Amanda Bakker, from all claims, demands, damages, losses, costs, and expenses of any kind arising from or in connection with your participation in any Cycle Strong Service, including but not limited to any injury, illness, loss, or damage sustained during training activities.
(b) You agree to indemnify and hold harmless Cycle Strong and its operator from and against any liability, loss, claim, or expense (including reasonable legal costs) arising out of or in connection with your breach of these Terms, your participation in any Service, or any negligent or wrongful act or omission by you.
(c) Nothing in this clause excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law or any other applicable law that cannot be excluded.
8 No Warranties
(a) We do not warrant that our Services or any third-party platforms used to deliver them will operate error-free or without interruption. We are not responsible for technical issues arising from third-party platforms including PT Hub, GoHighLevel, Stripe, or Facebook.
(b) We do not guarantee specific results from participation in any Cycle Strong Service. Outcomes will vary between individuals depending on a range of factors including personal health, consistency of participation, and individual physiology.
(c) To the extent permitted by law, our liability to you for any loss or damage arising in connection with our Services is limited to the amount paid by you for the relevant Service.
9 Intellectual Property
(a) All content, materials, programs, guides, resources, copy, graphics, and educational content provided through Cycle Strong Services are the intellectual property of Cycle Strong and its operator. All rights are reserved.
(b) By purchasing a Service, you are granted a personal, non-exclusive, non-transferable licence to use the materials provided for your own personal, non-commercial use only. This licence does not permit you to share, reproduce, distribute, sell, or otherwise provide access to our materials — including but not limited to workout programs, sessions delivered via any third-party coaching platform, educational guides, Facebook Group content, and live call recordings — to any third party, whether for payment or otherwise.
(c) You must not reproduce, copy, share, or distribute any Cycle Strong content or materials without our prior written consent. Any unauthorised use of our intellectual property may result in immediate termination of your access to our Services without refund.
(d) Nothing in these Terms grants you any ownership of or interest in Cycle Strong’s intellectual property beyond the personal use licence described above.
9A Testimonials and Social Media Content
(a) We may request your permission to use your testimonial, written feedback, progress update, or other content you share within the program environment for marketing and promotional purposes, including on our website and social media channels.
(b) We will only use your testimonial or content in this way with your prior written consent, which may be provided via email or a consent form communicated at the time of the request.
(c) You may withdraw your consent at any time by contacting us at [email protected]. Withdrawal of consent will not affect any use that has already occurred prior to the withdrawal.
(d) Nothing in this clause requires you to provide a testimonial or public statement about your experience. Participation in the program is not conditional on providing any such content.
10 Client Conduct
(a) You agree to engage with Cycle Strong Services in a respectful and constructive manner. This includes interactions within any private online community, group program environment, or direct communications with us.
(b) You warrant that you will not make any negative, false, misleading, or otherwise inappropriate public statements relating to Cycle Strong, our Services, or our operator that are not a genuine and honest expression of your own experience.
(c) We reserve the right to remove a Client from any Group Program or community environment where their conduct is disruptive, disrespectful, or in breach of these Terms. No refund will be provided in such circumstances.
11 Privacy
(a) We collect and handle your Personal Information in accordance with our Privacy Policy, available at cyclestrong.com.au.
(b) By purchasing or enrolling in a Cycle Strong Service, you consent to the collection and use of your Personal Information as described in our Privacy Policy.
12 Relationship Between Parties
(a) These Terms do not constitute you as an employee, agent, or partner of Cycle Strong for any purpose.
(b) Each party is responsible for their own tax obligations in respect of any amounts paid or received under these Terms.
13 Amendment
We may amend these Terms at any time. Amended Terms will be published on our website at cyclestrong.com.au. Your continued use of or enrolment in any Cycle Strong Service following publication of amended Terms constitutes your acceptance of the amended Terms. We encourage you to review these Terms periodically.
14 Termination
(a) We may suspend or terminate your access to any Cycle Strong Service by providing you with seven (7) days’ notice in writing, except where termination is due to a breach of these Terms.
(b) We may terminate your access immediately and without notice if:
• you commit a breach of any of these Terms;
• your conduct is harmful, disruptive, or threatening toward us or other participants;
• you engage in unauthorised use or distribution of our intellectual property; or
• we cease to carry on business.
(c) Where we terminate your access other than for breach, we will provide a pro-rata refund of any prepaid amounts for Services not yet delivered, subject to your rights under the ACL.
15 Governing Law
These Terms are governed by the laws of South Australia in force from time to time. The parties agree to submit to the exclusive jurisdiction of the Courts of South Australia for the determination of any dispute arising under or in connection with these Terms.
16 Severability
If any part of these Terms is held by any court or jurisdiction to be void, invalid, or unenforceable, it will be treated as changed or reduced only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void. It will then be binding in that changed or reduced form. Subject to that, each provision is to be interpreted as severable and does not in any way affect any other provision of these Terms.
